if she is forced to, then yes. it is a legitimate work related expense.

How does she report it (or does she) to her employer? Does she report her tips minus the 3%?

Meaning if your girlfriend received 1,000 in tips in a given year, does she report $970 as her tips or $1,000 in tips?

If she reports $970, the she gets no business expense.
