Lawers/Apartment question

217 Views 8 Replies 5 Participants Last post by  Chili
I've got a lease at the Gateway at Denton. And they will just not fucking budge on letting me out of it. There is no buy out nothing. I can't get any one to take over my lease because the apartments aren't even full. Do I have any options here. I understand that I signed the lease, but some things have changed and I need to be closer to Frisco because of my job. Do I have any options??

Just stop paying. They will evict you and keep your deposit. Thats better than what they are offering you now.
Isn't there an early termination provision in your contract? i.e. paying a fee to bail out without having it on your credit... ?
As far as them fucking up your credit, thay can't if you give them 30 day notice that you are leaving the property. The most they can do is keep your deposit.
When I was in college and lived in Denton apartments, we'd just pack our shit and leave.

I was in the same situation about a year ago. They told me there was no way I could get out of the lease. I talked to a friend who happens to be a lawyer. He said as long as I gave them 30 days notice they could do nothing more than hold the deposit. In the end they sent me back 350 of 1500. Not sure why but they did.

I think you're giving him bad advice. Why wouldn't they be able to send him to collections. Is there some law that protects him? If so back up your claim.

I broke an apartment lease in the past, with notice, and they hit me with collections. They ended up clearing it all because the lease had a military clause and I moved on orders, but they did send me collections initially. (They claimed I never gave them a copy of my orders, which I did they day I turned in my keys). Also, some complexes verify rental history and if they see you have walked on a lease they'll deny you.
