Apartment Complex Deposit - They gave back more than the deposit

I moved into this apartment 12 month ago and at the time it was owned and managed by a private owner. I paid him $250 for the deposit and he waved the pet deposit.

He was a fantastic owner (also owned a small bar and car dealership) - I could call up to the dealership and pay with a credit card for rent. We'll 6 month ago he decided to sell the complex to a management company.

The first month they had control of the apartment the rent went up $70. I had a few problems with the management company during the first few months. They lost my payment for the second month but thankfully I had a receipt that showed I paid. One month the grass outside was so tall I couldn't walk through it. I called like 15 times that month complaining about the grass.

I decided to get creative about the complaints after the first few days.

"I lost my car in the grass at the brownstone apartment complex! are ya'll ever going to cut it?"

"I was walking by the apartment complex over off 12th street and could hardly see the roof! I noticed ya'll manage the complex right? Do you cut it yearly?"

I also called to ask if I could cut it for them. "i'll cut the grass if you knock off some rent owed..." She tells me "We'll we have someone to cut the grass already" I ask her "Have you visited this place in the last month? The grass is over 3 feet tall!"

Anyway, I moved out a few month ago. I just received a letter in the mail and a check for $750 from the management company.

It also had a little list of what they charged me.

-$200 for carpet cleaning and housecleaning.
-$50 for keys not returned

It also showed a list of my records at the top. It showed I paid $1000 for a deposit.


I thought it was fantastic at first. Those suckers paid me WAY too much.

I have been thinking laity I should give the money back.... and then again I think I should just keep it because the idiot should have held better records!

To an appartment complex? FUCK NO. Them bastards charge stupid amounts of fraudulent fees. I have had to go to court twice to get fees back that were not owed, each time I paid to clean carpet and they replaced it with new.

Keep it and buy yourself a beer, and think about all us that got screwed around by them while you enjoy it.
Keep it. Consider it compensation for the shit you had to put up with the last few months of the lease.

Apartment Complexes are the worst when it comes to getting your deposit back. They will try and charge you for everything.

I'm curious as to why the rent would go up $70 when a new owner takes over. It isn't like you can buy a property and change leases that are in place already.
that money isn't going back to the original owner so keep it.
I'd give it back -- it's not your money. Funny that people would say keep it when they complain about the government handing out free money.
I'd agree, the money isn't going back to the original owner who initially took your deposit. I'd say keep it. They wrote you the check. I mean for all you actually remember, you might have paid a 1k deposit........Ya know, now that I think about it.....ya I did. lol

keep it, what does money from an apt complex have to do with government?? most complexes over charge on rent anyways
Another vote for keep it. I have derive distinct pleasure from arguing with apartment complexes over bullshit fees. I refuse to pay carpet cleaning fees ESPECIALLY when they replace the carpet. I refuse to pay non-refundable pet deposits for a cat (which I don't own anymore, and for a good reason). I refuse to pay a move in and move out fee, that's what rent and a deposit are for.
It could be the result of how the previous owner kept records. I am guessing since he owned a bar and a dealership, he was "shifting" money around to avoid taxes maybe? The new owner probably accounted wrong.
I'd ask them to recheck their records, because "I don't remember what I paid in deposits."

One of the reasons I always say that very few companies have morals. People have morals, organizations of people do not, with few exceptions. Once you get so big, it is all about business.

That is why I say, keep the money. They'd fuck you to death if they could.
The main reason I asked this is because my girlfriend is a CPA and spent all last summer auditing various companies.

She seems to think if they figure out this mistake in the future (because of audits or whatever) I could be held accountable for their mistake and could end up in small claims court for the money. I'm not sure I 100% believe that... but maybe?

Depends on the lease and if it has wording that will allow it or not.
