Quick CHL question on Churches and Schools...

I know that we are able to conceal carry at a church. My understanding is that we are not allowed to carry at any school..

My Church is a relatively young church. It leases an elementary school cafeteria on Sundays for church services. Obviously, school is not in session when we are having services.

The law is here: http://www.txdps.state.tx.us/adminis...ds/chl/ago.htm but it isn't 100% clear to me....

So my question is, am I legal to conceal carry to church services?

What do you guys think?

I'd say the whole "on the physical premises of a school or educational institution," would get you. As I don't see a clause whether school's in session or not.

Forwarded your question to my friend who's a CHL instructor for his input.

I don't think anywhere other than the sidewalk, parking lot, or driveways is a legal spot for carry when your talking about schools. You do conceal carry though, right?

His response:
Quote:
I am not an attorney, but the law is silent as to if school is in session or if the facility is being used for a non school event. Is does however says you MAY NOT carry on the premises of a school. Period To me it means just that 24x7. I think you would be a on a slippery slope if one choose to carry. Would you have an argument that the building was being leased for XYZ and not school, yada yada? Perhaps But an argument in court all comes down to what the man in the black robe feels like that day.

whether or not a school is in session does not change the fact that you are school property. It's not legal to carry a pistol into a school during summer vacation, neither is it on a saturday or sunday.

Our instructor said it could be had in the parking lot without 30.06 signs, but I know not in the building itself.
