51% sign where it shouldn't be?

Is this legal? Went to a local pizza place here in Denton which serves beer, but is DEFINITELY not making 51% of its revenue from alcohol, more like 5%. So is having that sign stating that they do and banning firearms allowed?

some people are like slinkies; they're completely useless, but still bring a smile to your face when you push them down a flight of stairs.

If it is J&J's I wouldn't be surprised if they did make that much off alcohol. They're a fucking rip off. Amazing Pizza though.

If they show a 51% sign dont carry ... simple. If you dont like being unarmed, dont go.

I'd find another pizza joint to go eat at.

Yeah, otherwise they can just put up the 30 06 sign if they really don't want guns in there along with the usual signs.

Edit: I feel (like smoking) they should have the choice if they want guns in their business anyway. Then I have a choice on using that business or not. Stuff is pretty simple really.

doesnt TABC issue the 51% requirement? If it has one..Im guessing they do it because they have to

There's a very good chance that I'm wrong, but I'm pretty sure that TABC determines whether their license classification is red or blue.

Red = no carry
Blue = not truly 51%, and legal to carry.

If you want to be absolutely cetain you can look on their copy of their TABC license and it'll be either blue or red.

Again, I could be very wrong.

Remember, some people are alive simply because it is illegal to kill them.

The law states if theres a 51% sign or a 30-06 sign, you may not carry within that facility.

Also for example, if the Post Office has a Gun with a line through it, technically you can not carry in there also. Reason : Federal Law Trumps State Law.

At the end of a day, if I see ANY 51% or 30 06 sign, I'm not carrying. I know there are specifications, but it always falls on you to prove something. W hich is court costs and hassle. Anyway, below is the TABC FAQ site and a specific quote.

http://www.tabc.state.tx.us/faq/general.asp

Quote:
10.I have seen two types of signs posted in retail establishments regarding concealed weapons. What is the difference between the two?

All alcoholic beverage retailers must post one of two firearms signs.

The 51% sign is required to be posted on the premises of establishments where the possession of any concealed weapon is illegal. These are establishments that are licensed to sell alcoholic beverages for on-premises consumption whose alcohol sales constitutes more than half of their gross receipts. These signs have 51% in large red letters superimposed over the warning which notes that possession of a concealed weapon on the premises is a felony.

Establishments licensed to sell alcoholic beverages for off-premise consumption or establishments licensed to sell for on-premises consumption whose alcohol sales are 50% or less of total gross receipts are required to post a sign that warns that the unlicensed possession of a concealed weapon is a felony. The holder of a concealed handgun license may lawfully possess a concealed handgun on these premises.
