DALLAS - A homeowner shot and killed a person allegedly breaking into a home early Thursday afternoon in the 7100 block of Fair Oaks Avenue in northeast Dallas.

Police received a call about the break-in and shooting at about 12:20 p.m. When they arrived on the scene, the suspected burglar was found fatally wounded.

I would probably rather just rather tell the guy to stop, put your hands up and subdue him until the cops arrived. It just doesn't seem right to shoot an unarmed person for breaking and entering. Of course, we don't have all the facts or even know if the suspected burglar had a gun.

Dude you need to talk to your union rep, the jailers at most of the jails I have seen get at least $100 a pack.

Why should an innocent person have to use his hands to subdue anyone? They are in their own home. If you dont want to get shot dont break into people houses. Simple. Do you think burglars breaking into peoples house wearing a sticker that says "Hello my name is 5.0 SVO I am unarmed, and Im just trying to steal your stuff do not shoot. You can attempt to beat my ass if you like though."

What happens if the only person home is a Small woman? Or a teenage boy? Should they also have to fight off an intruder because you think they dont have the right to shoot someone who they dont know the intentions of? I have a little sister at home, if someone breaks in my first reaction is going to be to defend her. And I am not going to start wrestling with someone and possibly get stabbed because theres a possiblility that intruder just came in to steal something. You have a very odd way of thinking. One day you will find yourself in a tight situation, and you will probably change your tune quickly thereafter

you guys just like to argue about this subject. You think the citizens should take care of crime and not the police. I think that's called vigilante justice. That's what communities do when their local police aren't doing their job. So I can understand why a police officer would promote that. Especially if they don't like their job or maybe they are just downright scared of their own community.

It isnt vigilante justice when someone breaks into your house and you are in fear for your life. It is called protecting you and yours...if that means taking a life, then so be it. People that break into other peoples homes are unfit to live among us.

Well said doc.

If we, or anyone, went out on the streets looking for criminals to punish/execute/whatever on our own, then that would be vigilante justice.

Completely different story when a criminal comes into the home of any law abiding, job keeping citizen.

It isn't vigilante justice when normal citizens defend their home, property, and/or family against criminal invasion according to laws that are on the books in this state and nation.

It's just common sense man.

Remember, some people are alive simply because it is illegal to kill them.

I agree with Ted about most things. I don't agree with him about an imaginable being giving non felons certain rights. I do believe everyone has human rights and if one of those rights is to protect your family at all costs then that would also include killing in self defense, stealing to feed your starving family, and so on. So if it is your right to kill a THIEF then it is a thiefs right to kill to feed his family.
See how that works?

Yep, you're still clueless. What do you not get about not infringing on the rights of others? Defending one's home is simply a reactionary measure, it's the burgular that is infringing by putting both himself and the homeowner in that situation. Stealing is an offense, protecting is a defense, they are completely opposite actions.

BTW if you really look at what Ted has to say, he is backing me up. I am not a violent person. I have been in maybe 3 fights in my life including Jr High. I was arrested while on probation for carrying a gun to protect myself. I have never pointed a gun (real gun) at anyone. I was labeled as a violent person by the court system after that. That was before I was ever convicted of a felony. When I was convicted of a BMV they gave me an 8 year sentence and treated me like I was a violent person. I think everyone has always assumed I am a violent person just because of the way I look. But hey, sometimes the best defense is a good offense.

In every example Ted gave he told a story about someone that was truly in fear for their life. I never once heard him talk about killing someone because they were a criminal. Sounds like his biggest problem is with the judges that dont give proper sentences to hard criminals.
He speaks of defending his gift of life. Not defending the banks property or the insurance companies property. life

Pretty much, only in your home or place of business. Though anytime you genuinely feel that your life is threatened you've gotta a pretty good defense from prosecution. In other words killing your asailant isn't necessarily legal, but you probably won't go to jail for it by pleading self defense.

Conversely if there is video of you shooting the guy with his hands in the air surrendering, even if it's in your home you're most likely going to prison, castle doctrine be damned.

You are seriously lacking in common sense dude, but then again, that's probably how you came to the conclusion that being a theif would be a good idea. It all boils down to the fact that there is absolutely no plausible defense for ANYBODY under ANY CIRCUMSTANCES to steal from someone else, so quit trying.

If I am not mistaken it is legal to kill someone that is breaking into your car at 3:00 in the morning.

There shouldn't even be an argument here dude, this should be one sided. Nobody should be on the side of the criminal. Why do you continuously argue on behalf of low life, piece of shit people who the only thing they can contribute to society, is bringing it down.

You are right. You should just start shooting anyone that breaks any law. Nobody will fight for those people. Go ahead, lets see where that gets you.

Taking the criminals side doesnt make you look very smart, laws were put in place to protect innocent people, that is why you own or carry a weapon, when you break those laws you are giving up those rights. you said so yourself, you got into trouble for carrying while on probation, you couldn't have had a chl, so you where breaking the law. maybe you shouldn't have put yourself in that position, maybe if you needed to protect yourself you should have thought about talking your way out. you obviously planned on lethal force to protect yourself, so why shouldnt i do the same thing for my family? you havent made one good point yet.

I find it interesting that you periodically disappear for 3-4 months at a time and the first thing you want to talk about when you come back is defense attorneys and criminals as victims. Unless you get a grip on citizen's gun rights one of these times you won't be coming back.

Propaganda death ensemble (see above)
I have a grip on citizen gun rights. I believe a law abiding citizen has the right to bear arms. I don't believe anyone has a right to kill someone unless it is self defense or punishment for murder.
You dont like me talking about defense attorneys? Sorry if due process scares you. Seeing as how you think I talk about them every 3-4 months.

Appearently you have never had to apply for a chl because with your record the state will not give you one... and Ted is not the law or you should have quoted him when they arrested you for carrying a weapon....see how far that would have got you.

Don't bother replying to 5.0 svo unless you like feeding an attention whore. He has no place in this part of the site, and both he and the rest of us know that. Suffice it to say he is a convicted felon who served as a prison bitch and is still butthurt LOL about all that to this day.
