Filling Souter's seat would be President Barack Obama's first Supreme Court appointment -- and the first since George W. Bush's picks of Samuel Alito in 2006 and Chief Justice John Roberts in 2005.

Souter, 69, was tapped for the court by President George H.W. Bush in 1990, but disappointed many conservatives when he turned out to be a typical old-fashioned Yankee Republican -- a moderate, with an independent, even quirky streak.

Souter's departure will leave the two oldest justices -- and the most liberal -- still on the bench. Retirements for John Paul Stevens, 89, and Ruth Bader Ginsburg, 76, have been rumored for years, with many expecting that one or the other would be the first to give a new Democratic president a Supreme Court vacancy.

Souter's decision came as something of a surprise, although he has long been known to prefer the quiet of his New Hampshire farmhouse to the bustle of the nation's capital.

Won't affect the balance (or imbalance) any. One liberal out and another in. There could be 2 or 3 more retire during Obama's first term though.

Good, we need Liberals running everything. Hopefully he'll pick someone that thinks the constitution is a living, breathing document and won't have any problems legislating from the bench.

Come on... If he wasn't liberal his name wouldn't be an insult to Reps. And he isn't even the swing voter. That's Kennedy.

Since they all wear black bath robes could you really tell if one was a cross-dresser?

I expect a woman with little history on Roe v.v Wade

Just a little. Part of me wants him to appoint a worthless die hard liberal just to see how much worse it can really get. Only problem is that once he's booted out of office and Congress has swayed more to the right we'll still be stuck with whomever he appoints.

She has a J.D. from Harvard, the same degree Chief Justice John Roberts has. Education wise she is better qualified than everyone on the supreme court other than John Paul Stevens, Clarence Thomas and John Roberts. The others have the equivalent of a bachelors degree while Michelle has a doctorate (as does her husband).
