Botched Oath of Office

Anyone else hear that clusterf--k? lol

So they're already talking about this being a ploy, supposedly to keep him and the Supreme Court from getting in serious legal stink over Barry Sobrero not meeting the Constitutional requirements for presidency yet knowingly taking the Oath of Office.

I'm sure the right wingers will take that and run..

Way I understand it from my days of constitutional history is that no matter what on Jan. 20 at high noon, he's president .

Honestly, It was down right depressing from what I saw (was at work). He continued the doom and gloom speak that the media has been spewing for months, I left the room after he said "future generations need to lower their sights".
WTF!
Why is he not trying to build folks spirits up and have a decent outlook, I guess if he preaches doom he can try to make himself look like a bigger hero when things turn around.

The oath does not have to be taken on a Bible, whether he did or not. It's the same oath you take when you commission as an officer in the armed forces, and there is never a Bible used there.

The oath in general is really just a formality, as has been said several times. He's POTUS at noon 20Jan, oath or no oath.

You might want to get out your 10th Grade Government text book. In it you will find that the Speaker of the House is third in succession to the president followed by the President Pro Tempore of the Senate and then the Secretary of State.

This is how I see it. I there is no Pres or Vice Pres. Then it goes to the Speaker of the House, then to the President Pro Tempore and then to the Secretary of State. But, Pelosi and Bird were not yet qualified so the next in line would be Rice, at least in that moment in time.

What do you mean not yet qualified? They hold the respective positions. What is the point that you are trying to make? Whether Obama was president at 12 noon on the 20th or when he correctly recited the oath of office can be left up to constutional experts/attorneys and Supreme Court Justices. Two other presidents had the same thing happen and had a "do over". It isn't a big deal.

I was only trying to give an explanation on how I came up with the order that went straight to Rice. Both the Speaker and and President Pro Tempore of the Senate have to resign there respective post and since they had not resigned it went to Rice.

In order to be qualified they have to resign there post.

Resigning a post is a formality. The line of succession is law. I don't think that LBJ had time to formally submit his resignation when he was taking the oath of office in Air Force one.

As the thread starter, I would like to interject my .02. Obama was President of the United States as of noon on Tuesday January 20, whether or not he took a proper Oath of Office. There is nothing in the Constitution (or anywhere else) that claims the man HAS to say it to be President.
