i have had a hold put on my name. :confused: i am guessing its from the dwi i got last yr? or maybe my son whom is a jr. or technically a II? or maybe my wife got to the feds and told them i have enough guns already?

Probably because of your DWI. Is that settled yet?

nah, they cannot find the tape, and at the last courtdate the police report couldnt be located either. :confused: i aint sure whether thats good or bad.

I'm fairly certain they put a hold on you until after your case is settled, but hopefully someone else more knowledgeable about CHL laws will chime in.


And for the record, I'd think that is good. No tape, and no report = no evidence.

Since they need that shit to prove their case, it's good. But they will just keep putting if off and it will stay with you until they decide to quit or find it the stuff they need to fry you.

if they put a hold on your name, that means they police already made their decision. Did you really get a DWI? It sounds like you didnt and now your trying to have them find the evidence proving your innocence. Even if it does stick, it will be removed in I believe 3 yrs.

So did they say it was denied, or you have a hold meaning you will more then likely be able to pick it up in 5 days?

i am not sure i understand your question. i was arrested for dwi leaving the dfwstangs christmas party last Dec. i have paid $5k to a lawyer, my lawyer has subpena'd the officer to bring the tape, the DA said they do not have it in the video library. they now have 30 days or the tape will be inadmissable in the trial. i had been drinking, i took the physical test, but refused the blood alcohol breathalyzer.


chopped54, they said they will call me and let me know. i have a family member thats had "legal firearms issues" same last name so i was just trying to narrow down my "hold" he said sometimes they come back with an answer before you can get out of the store, or the next day. i will keep interested parties informed.

So long as its not your 3rd DWI, it should not prevent you from buying a firearm.

A Class A&B Misdemeanor (Spelling) will stop you from getting a CHL For 5 years. You can have an assault on your record (Class A or B) and that will pass a firearms background check. The only things that will zap you is felonies, domestic violence, having a Class A or B Warrant out on you, etc..

If you get like 3 convictions of an alcohol offense within (I think its like 1 year to 2 years) they consider you an alcoholic and you can't get a CHL.

(After 2 DWI convictions, the 3rd one is a Felony and that will take away your gun crimes).

I am sure you will get the gun, just dont go somewhere else and try to get another one.
Depending on the store, you may have to call them, , usually takes about 5 days

I had one put on hold because I put the wrong social. Had one put on hold because my license had expired, and just been renewed with a different address.

When you get a Delay on a NICS check the only thing it means is NICS could not immediately process your background check. If the FFL doesn't hear a responce from NICS they can sale the gun in 3 or 5 days(its been awhile i dont remember the exact time period) at their discretion(some won't sale till they hear a response).
