View Full Version : Thinking About Extending my Driveway

OK...I have a 3 car garage with a fairly short driveway. The house sits on the corner of a dog leg street, so it is a side entry garage that faces the street. I am about to buy an enclosed trailer but do not want to park it in the driveway and there is no hope of getting it in the garage. I have a gated fence that leads to the backyard right next to the garage so I am thinking I could extend the driveway on the side and have it continute beyond the gate into the backyard where I would park the trailer.
Problem is, this is all right by the property line and I do not want to foul the easement. Who do I contact to do this right and make sure I don't get into trouble with the city?

Flatwork is not considered a "permanent" structure. If it's on your side of the fence, it won't be an issue.

it really depends on which city your in. Most of the cities i deal with you will need to be three feet of of the property line.

I was thinking his fence would meet that criteria, so if he stayed inside it, he'd be OK.

Easements vary, check your copy of your survey. Its a surveyors report that shows all easments and any encroachments in place at the time of sale. If not available, you should be able to contact your local city code enforcement and they can tell you exactly what the restrictions are for your address.

Thanks guys...technically, I live in Haltom City. We have the drawing around here someplace. I guess ultimately I need to contact code enforcement and find out what my options are.

Yup. Also, a lot of times they have it all on their web site too so you can research it before showing up and asking questions/beg for an exception to the rules.

Are you certain there's an actual easement on your property? Do you have a plat indicating an easement?
I just went through this EXACT scenario. Widened my driveway adjacent to the property line and there's a 5 foot Electric Easement along that side of the property.
The City of Rowlett required a letter of approval from ONCOR before they would grant me a permit to widen the driveway over the easement. It took some work on my part, but I finally got the letter and finished my driveway a few weeks ago.
FWIW - I was able to widen my driveway all the way to the property line - the City had no problem with it.
Each City will be different and it depends what kind of easement you've got. If it's a "Utility Easement", the city may require you to get approval from all of the utility companies (ONCOR, Atmos, etc) before they'll let you pave over the driveway.
Being that the driveway isn't technically a permanent structure (it can be torn out if a utility company really needs access to the easement, though probably at your expense).
Your best bey is to contact the city and see what they say. None of us can really answer the question...

This is very true. There are also utility and electrical easments in some cases that if you for some reason cover up you will be forced to remove. If you go to your cities building inspection dept you should be able to get a copy of your plat plan which shows all build lines, easments, drainage etc.
