till I piss off at least 3 people. Some guy today tries to stop me from do something not legal here just yet. So he gets next to with his window up mouthing something, so in turn I use my right hand like a puppet mouthing back to him :D . he then rolls his window down to start mouthing me some more and i still cant hear him. then he honks for a cop that is working a traffic accident to "bust me" i guess, even though i wasn't doing anything illegal when the cop had me in view.
cagers are funny dumbass' i think he was pissed because he can't do what i was doing and he was stuck in the stop and go traffic.

It is legal and has been for almost a year now. I wont split lanes in fear that some asshole that doesnt know the law or is mad because im getting ahead of him will swerve into me.
But i will ride the shoulder just a little faster than traffic. And i only do that because the bike gets hot between my legs

I have had people get mad like that when I would ride the shoulder in traffic. I almost had a trucker try to get out and fight me once in mesquite. Traffic makes the blood boil in too many people!

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 545.060, Transportation Code, is amended
by amending Subsection (a) and adding Subsection (e) to read as
follows:
(a) An operator on a roadway divided into two or more
clearly marked lanes for traffic:
(1) shall drive as nearly as practical entirely within
a single lane, except as provided by Subsection (e); and
(2) may not move from the lane unless that movement can
be made safely.
(e) The operator of a motorcycle may operate the motorcycle
for a safe distance between lanes of traffic moving in the same
direction during periods of traffic congestion if the operator:
(1) is at least 21 years old;
(2) has successfully completed a motorcycle operator
training and safety course under Chapter 662;
(3) is covered by a health insurance plan providing
the operator with at least $10,000 in medical benefits for injuries
incurred as a result of an accident while operating a motorcycle;
and
(4) operates the motorcycle:
(A) at a speed not more than five miles per hour
over the speed of the other traffic;
(B) in traffic that is moving at a speed of 20
miles per hour or less; and
(C) in a location other than a school crossing
zone or other than a location where the posted speed limit is 20
miles per hour or less.
SECTION 2. This Act takes effect September 1, 2005.

i have talked to couple cops that come to my work and ride and they have heard about a new bill to be looked at either this month or next. the problem with the past attempts is that the lane splitting potion is buried in a bill that gets shot down.

yeah if you read the link at the bottom theres an update saying it didnt get passed. It would have been effective in September of 05 though, its whatever though, if someone gets pulled over for this and trys to explain that dfwstangs said it was legal... i dont think its gonna work out very well

Whether lane splitting is legal or illegal depends on how a judge (or jury if you go that route) interprets the law and the accused rider's actions.
If a cop sees you doing it and decides to pull you over you will likely get a ticket.*
However, if you were in stop and go freeway traffic, not riding erratically, not traveling significantly faster than the flow of traffic, and you hire a lawyer will likely beat it.
For those of you who don't ride and only come in this forum to talk shit, #1 fuck you, #2 studies in california have shown that lane splitting is safer for motorcyclists than sitting in traffic and it helps to relieve congestion.

Yea if you open your door and take out a biker it can be called attempted vehiclular manslaughter because the guy on the bike had no intention on hurting you or your vehicle. And being its legal to split lanes with traffic is heavy (which i verified at lunch by a denton motorcycle cop today) you would be at fault. No reason to hurt someone because they are getting somewhere faster.
I hate riding in heavy traffic because people dont pay attention and end up swerving into my lane.

I rarely ever do it. If the traffic is dead stop and it's 100*+ (WELL over 100 on the pavement) I'll slowly cruise past people. I don't get on the shoulder because I don't want a flat and I don't want my rear tire tossing debris on cars.
I would like to do it more often, but having jealous people attempt to murder you really gets under my skin and I'm too old to go around breaking the windows and mirrors of everyone that is trying to kill me.

well said. I leave for work around 4:15am. I have a straight shot up 35 for 25 miles. Going to work 85mph to 90mph. On the way home with traffic rarely over 65mph and with the flow of traffic. I do not want someone to switch lanes, not see me, because I am hauling ass, and me not be able to get out of the way or slow down fast enough. That being said, i have no problems with riders who do split lanes. Every rider should ride the way they feel comfortable. We put our life at an increased risk every time we ride, so we should decide how high that risk will be. Many riders have died doing nothing wrong.

But he's not a cop, I'm not going to say he's the authority on the subject.
But that really doesn't matter. You'd have to be an idiot to do it. People give a quick glance and jump across lanes all the time. They won't be expecting you to be running up on top of them. I love how all the bikers say "the bike is running hot" and "I'm only going 5 faster than traffic." Yeah right, give me a break.
Enjoy getting to your destination 10min faster a few times. Eventually some idiot or asshole is going to make you wish you had just sat there with everyone else.

you missed my point......i dont lane split to get anywhere faster.....i do it when traffic jams up and the bike starts to get hot. if traffic is doin 30mph..i stay right where i am...its a good breeze lol

I really don't understand why people think lane splitting is so bad and dangerous really. I mean, I can understand getting mad while you're stuck at a stand still, and the biker is pacing right along, granted he's doing a safe speed. But that's just natural to get ticked when someone is moving right along and you're stuck. But not mad enough to fling a door open or anything.
Now, I can see where I'd get pissed if some douche comes flying through splitting lanes at 35+. That could be very dangerous for someone with their window down, but it's more dangerous for the rider.
I guess I just don't see it. It doesn't make my blood boil like the idiots that slow traffic on the highway to stunt.

I spent several days around LA about 10 years back, and "lane-splitting" has a whole 'nuther meaning! :eek: Man, those dudes were FLYING between lanes, with traffic stopped all around them. I actually feared for them. The people I stayed with showed me that they have several bike accidents a day, with some of them directly related to "lane-splitting", but none intentional.

You know I don't mind "non" riders posting up in here. I don't mind someone offering there opinion about things. But when you talk about trying to intentionally hurt us I take a little offense to it. I don't necessarily agree with lane splitting ad speed but leave the law enforcement to someone that actually has the power and not take it into your own hands. I've only split a lane once and that was after being stuck behind quite a few vehicles traveling the same speed and pretty much holding up a big line of traffic.

Roadrage people swerve at each other in cars without any real consequences. If they hit each other, so what, they get some body damage. You hit a bike and you can end someones life like that. It's been my experience that when a bike and a car get in an accident that the person driving the car won't even stop to help. I know it's happened to people I know as well as myself. More often than not the car drives off and leaves you broken and bleeding in the street.
TINKRD sure is coming across as the guy that's going to swerve, that's going to open his door, and if the rider happens to defend his life with deadly force TINKRD knows he's going to shoot as well. All for nothing.

hes just letting you know that if you swerve at a bike and the guy riding is a crazy sumamamabitch then you might get shot at. ive seen some guys riding rat bikes that really carry chains and bats.......it would be a good idea just to stay in your lane and let them kinda people go on ahead.

When pulled over on the bike a couple weeks ago, the cop asked my why I didnt have my gun on me, He said to start riding with it. I explained it is a springfield 45, his response was it could come in handy. I dont put a lot of faith into the CHL vs no CHL but I have mine just to avoid any extra questions if the time comes when I need it.

In my mind (and a lot of people that ride to), a vehicle, door, something being thrown out a window is every bit a deadly weapon to a motorcyclist than a gun is. You bang sheet metal with another automobile and you walk away. Doesn't necessarily work out the same for those of us on two wheels.
You may throw out your hint but I'll come right out and tell you if someone pulls that shit on me and I can do something about it, it'll be more than a threat.
There was one occasion either last Thanksgiving, or year before that, a group of "stunters" took over all four lanes of 183 just East of 360 and they slowed down below the speed limit. I thought about running over a few of them. Some other people looked like they tried to but didn't get quite close enough. I can tell you that I saw the other side of it and wish I could take the law into my own hands. It's idiots like those stunter's that give the rest of use a bad rap.

I don't give a damn if a motorcyclist is doing something horribly dangerous and/or illegal, I give them plenty of room and drive to accomodate them. If they are trying to get around, I get the fuck out of the way. If they are trying to one wheel at 80, I get the fuck out of the way. First and foremost I don't want to see someone get hurt. We have all done dumb things at some point in our lives. Some of us have paid dearly and some have not.

My first rule in traffic. If I can't do it in the car I do not do it on the bike. Getting to where I am going a little bit faster is not worth the risk of some jerk taking me out, or someone not expecting me to be there.
I agree... I've yet to be in that big of a hurry... even riding in the August heat the past few weeks...
if traffic is bad, I'll ride the service road and just cruise... theres a time and place for hauling ass and doing silly shit... rush hour traffic isnt it...
