I just found out a buddy of mine just tried to buy a Smith and Wesson 9mm. Apparently for target shooting and such. He just called me asking if I knew any good lawyers, because apparently he's scared shitless. LOL They denied his application and issued him a summons.

i was wonderinth the same thing. is there something specific about this in his probation? is he on probation for a violent offense?

odds are it is on tape somewhere especially if it was at a large store. i think lying will make it worse....

he got caught with a little bud. misdemeanor possession as far as I know.

i bought two while on probation for dwi. first one i bought with no problems, and that was for an "assault rifle." second one got delayed. on the second day of the delay i got a call from my probation officer asking me what i needed a gun for. I told her it was a $1100 collectible 1911(just a Kimber bla bla). she said "oh" and that was about it. she did tell me to be safe though. if it is not something that maxs at i think 360 days in jail and not a violent crime, then there is not much they can do.

Hmmm, that makes me wonder. I'm currently on probation for the biggest mistake of my life (dwi), and i may be moving back to austin soon. Well, i'm unsure of where i'll end up in Austin, and just in case, i'd like to have a firearm before i move. I've gone through my probation papers several times looking for anything about not being able to purchase a firearm, but haven't found anything. :(

I don't see how a petty marijuana charge prevents someone from purchasing a firearm, while on probation or not. Parole? That's a different story.

That said, I'm a little biased due to my still not being able to 'legally' purchase firearms 20 years after I got stuck in the ass by the legal system because I made a stupid decision at the ripe old age of 17...

I mean I guess if the terms of your probation prevents it, but....

Assuming he went through a dealer etc.; wouldnt they just say, "no"

I totally agree that there should be laws prohibiting people with criminal records that are a danger to society from the purchasing of firearms.

But I also know that if you make a mistake when you are not even old enough to buy beer and then be a good boy for over 20 years you should be given a second shot at it, instead of living your entire life as a damned pariah... :rolleyes:

You can file paperwork with the ATF to be able to purchase and own a firearm(s). Of course they haven't green lighted anyone in the last 20yrs, but I guess it never hurts to try.

A non violent misdemeanor will not keep anyone from getting a firearm. A felony will. In most cases, someone that is on parole isn't on parole from a misdemeanor. Most of the time parole = felony.

I know, that's why I asked for the specifics. It makes a huge difference if it was a small little marijuana charge or a violent crime IMO.

BTW, have you looked into an expunction or some type of record clearing because of the long time since your conviction and your lack of any other CH?

I was trying to read some info and if i'm right after 5 years of release date or some thing like that you can own one at home. You are able to own one at home but not buy one, it makes no sense.

Yes, parole is a release from a state correctional facility ie; prison. While probation is for misdemeanor charges. Now a person can be on probation for a felony but cannot be a parole for a misdemeanor since a person cannot go to prison for a misdemeanor, now if the misdemeanor is enhanced and brings the charge to a felony level than prison is a possibility. Like a person that is arrested for DWI but has two previous convictions (not arrests) then the third DWI would be a SJF (state jail felony). This is for Texas.

Also a person with a felony conviction that has five years from the final conviction date can own a firearm in his/her home, but cannot transport the weapon or have the weapon in their possession outside the home.

Anywhere that is in black and white? ATF website?

My buddy went to jail for that.
He was convicted of a non violent crime 6 years ago and bought a registered gun and had it at his house. he just bought the gun less than 4 months ago
He was still on probation. Had like 6months left until he was off probation. But he last conviction was 6 years ago.
Waitng for him to go to court and see what they are going to do.
