Good. The guys over there shouldn't have to worry about lawyers...

Or murder charges in the middle of an armed conflict.

"excuse me Abdul, but would you mind not shooting that AK in my direction? I'd hate to have to write you up..."

ROE licks hadji ass when dealing with these guys. You can't fight a conventional war against an unconventional enemy.

Wonder if this shit would still be going on if we could fight like we used to.

Absolutely not. Everything chaged after WWII. Look at Korea, Viet Nam, etc. All this NATO, UN, Geneva bullshit only ties the hands of someone like us. It's like banning guns. The only people at a disadvantage are the ones who obey the laws.

"The evidence does not support a referral to a court-martial,"

They looked at it and made a decision. Sounds fine to me.

Most of the opinions seems to imply the soldiers there shouldn't be held to a standard. A standard set by the USA, not our enemies.

For you experience military guys, is it easy to end up in a court-martial situation in Iraq? What kinds of actions would you not perform or limit due to fear that you might get court-martialed for it? What kind of action that is not currently permissible would you liked changed to permissible?

Iraq is completely different than any other war. You don't have an army, you have an enemy among innocent civilians all with the same appearance. If you're being fired upon and can't tell who is who, then what are the ROE?

I don't know. What is the current ROE in these situations?

Don't fire back until you can directly identify the engaging enemy. Make sure the weapon he is pointing at you is loaded. Make sure it's loaded with live ammo and not blanks. Ask him if he is trying to hurt you. Make note of his name, the time, location, 20-digit grid square. Confirm that the ammo is indeed live. Ask him to stop. Attempt to subdue him and arrest him without harming him. If he stubs his toe, get him a lawyer to sue us and render him better medical aid than is available to our troops.

Funny response, but how does it really go down?
You’re on patrol. You take fire from some building on the left. What are your options within the current ROE? What additional options outside of the ROE would you like to take?

Must have positive ID to return fire...even muzzle flash is enough to obtain positive ID, if I'm receiving fire from a building on the left, the .50 on the roof of my truck is going to turn that room/floor/balcony into swiss cheese.

In fact, that's the majority of type of direct fire contact we take here downtown, RPG's/small-arms from buildings....Hell I've put the crosshairs of my Mark 4 on muzzle flash coming from a mosque window more times than any other type of incident...

The ROE *really* isn't unreasonable, especially given the circumstances...the only thing I'd change is the mosque-entry rules, but even the way they are now, we can still cordon it off and wait for locals to come do our work for us, and the Iraqi Army battalion that works with us fucking hates the AQI dudes, they really get to have fun when they find 'em... (now the Shi'a-controlled mosques are a different story...)
