Score one for the good guys... I think. Makes me wonder why he would have 5 people busting into his house and demanding access to the safe. Either it's someone he knew or he's into something illegal and was being robbed because of it. Definitely not random.

Armed homeowner thwarts home invaders 12;31 PM CT

From WFAA-TV stafff reports

Dallas Police were searching for at least one more person in connection with a home invasion early Wednesday that left one suspect dead and possibly two others shot, police said.

Four men, possibly five, forced their way into a home in the 9000 block of Woodshore Drive shortly before 2 a.m. Wednesday, robbed a man at gunpoint and fled with a “large sum of money,” said homicide detective Sgt. Larry Lewis.

As the men ran to the getaway car, the resident fired at them with an AK-47 type rifle, killing one and critically wounding another, police said. An abandoned car with the men inside was found a couple of blocks away. Police are trying to determine whether the armed men fired back at the resident. He was not injured.

The injured man was taken to Baylor University Medical Center. Police said a gunshot victim who showed up later at Parkland Memorial Hospital may be linked to the home invasion attempt. The man killed was Mario Moreland, 24, according to the Dallas County medical examiner.

The robbers seemed to have targeted the house and knew the contents inside, Sgt. Lewis said. Upon entry, the armed men went straight to the back bedroom, where the man and his girlfriend were sleeping, and demanded access to the safe inside the residence, he said.

The resident said he didn’t recognize the armed men, police said.

Two men are in custody but charges haven’t been filed yet. Police were trying to determine how many men entered the residence and were in the getaway car.

The resident, whose name is not available, would most likely not face any charges, but the case would go before a grand jury, Sgt. Lewis said.

I inspected a 1mil+ home north of SMU that had been robbed 3 or 4 times in the last 6 years. The even held him at gunpoint at one time. He had a safe room installed, with like 20 cameras, and an inground safe in the room after the attacks. He was just some old rich doctor, so It might have not been illegal.

But it's ok this time?

Chapter 9 Section 42

§ 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

wondering if the guy did know those people for real and was involved in something illegal... maybe not, but it's a good question.

Wow! Some shit happen like that to me and I'd probably consider moving.

Still, I think the original story sounds fishy. The guy went after them in his car with an AK-47 (they edited the story from this morning and were talking about possible charges because he discharged his firearm off his property). Regular guy (like your doctor) I don't see going to that much trouble.

So what is he looking at, discharging a firearm within a city limits. A class A Misdemeanor, maybe. I would take that for wacking a few dirtbags.
