NICS Improvement Act of 2007. I appreciate hearing from you on
this important matter.
Representative Carolyn McCarthy (D-New York) introduced H.R.
297 on January 5, 2007. The NICS Improvement Act of 2007
amends the Brady Handgun Violence Prevention Act to meet
certain requirements. The amendment requires: (1) the head of
each federal agency with records relating to individuals for whom
receipt of a firearm violates federal or state law to provide that
information to the Attorney General for inclusion in the National
Instant Criminal Background Check System (NICS); (2) the
agency to correct the record and notify the Attorney General upon
being made aware that the basis under which a record was made
available no longer applies; and (3) the Secretary of Homeland
Security to make available to the Attorney General records
relevant to a determination that a person is disqualified from
possessing or receiving a firearm and information about a change
in such person's status for removal from NICS.
Under H.R. 297, the Director of the Bureau of Justice Statistics is
to analyze and evaluate NICS operations and report annually to
Congress and specified states the best practices. The Comptroller
General's duties consist of conducting an audit of the expenditure
of all funds appropriated for criminal records improvement in
order to determine how the funds were expended.
In addition, the NISC Improvement Act of 2007 directs the
Attorney General to award grants to: (1) states and Indian tribe
governments for the purpose of establishing or upgrading
information and identification technologies to determine eligible
firearms; and (2) states to improve automation and transmission of
criminal history dispositions, records needed to determine if a
person has been convicted of a misdemeanor crime of domestic
violence, court orders, and mental health commitments to federal
and state record holders.
