Whats the law about carrying a handgun in your truck? do you need a chl to keep in reach? i go to the shooting range alot and was just wondering if i can keep it in there when im not going there.

You're ok if you're just going to the range or back. I'd keep it unloaded and secured in a case for good measure.

the law says if your traveling you can keep the gun loaded as long as it is concealed. i had a chance to talk with a local cop about this and he said it was a grey area and you could still be takin to jail if the cop wanted to. either keep it unloaded in a locked box or get your chl, its not worth the BS.

I would not. Yeah you may get away with it, but that one time could bite you in the ass. Just go and get a CHL. It will make life easer.

im going to get my chl soon, i was just unsure of the laws until then. I keep it behind the passenger seat un the box unloaded when i travel to the range

second you are to have the ammunition seperate from the gun. period.

When I was 19 got busted with a 45 in Houston Memorial Park...damm cop almost shot himself in the foot (1 round in chamber)...as for me went straight to jail. Got the 45 back though...
Carrying weapon isn't a good idea unless you are law enforcement authorities.

Not true..
I've been pulled over by both troopers and city police both in Johnson county and wise county.Ive ALWAYS told them right from the begining that I have a pistol behind my seat in the seat pocket(truck) They usually ask if i have my CHL and I tell them no I only carry if im driving from my house in Keller to Alvarado or Decatur,so i never saw the need to get one.Never had any problems.And BEFORE i started doing this,RIGHT AFTER the new law ws passed I asked Troopers that I saw or sherrifs that I saw at stores or food places.
If your driving down to Mc donalds then I think cops might give you shit about it,but actually doing some distance driving at night most wont,as long as your not some asshole.
Just to add.I have also spoken with tarrant County Dee Anderson about traveling and he follows what the law says,As long as your in in the bounds of the law you are ok.

actually it is true. the officers were being nice to you.
You can only carry a loaded gun with a chl.
You can carry a gun when traveling... The ammo is to be stored as you would be traveling. A gun isnt to be loaded when your traveling. Its more of a transporting the gun than actually carrying one. Your not intended to be able to use the handgun if your just transporting it. Carrying is a complete different thing.
The law is confusing.
Ive been charged with UCW and beat it. I know the actual law as from the court, judge and my lawyers. I was traveling to Houston from Dallas. I beat the charge but caught a ride and hung out in jail for the night.
Its kinda sad all the different police depts dont even know the correct law and what is legal. You better know the law if you get pulled over or you might catch a case also.
The cop that gave me the UCW was eyeballing my springfield XD .357 pretty hard and kept playing with it. I think he just wanted my gun.

Anyone who can legally possess a firearm, and is traveling, can carry it inside a motor vehicle. The firearm can be loaded and must be concealed. If it is in view it is a violation of the law. Law beocmes effective 9/1/05.
§46.15 (i)
(i) For purposes of Subsection (b)(3), a person is presumed to be traveling if the person is:
(1) in a private motor vehicle;
(2) not otherwise engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic;
(3) not otherwise prohibited by law from possessing a firearm;
(4) not a member of a criminal street gang, as defined by Section 71.01; and
(5) not carrying a handgun in plain view.

New Law on Carrying Firearm while “Traveling”
(House Bill 823, 79th Regular Legislative Session, amending Penal Code
Sections 2.05 and 46.15)
In Texas, it is generally unlawful to carry a handgun in public, including within a private
vehicle. However, Texas also recognizes several exceptions. One such exception is applicable
when the citizen is “traveling.”
“Traveling” has never been defined by the legislature. Texas courts have said that in
general, the determination of whether a citizen is traveling is to be determined on a case by case
basis, depending on the specific circumstances. Texas courts have generally considered the
distance, time, and mode of travel in determining whether the citizen is traveling and have found
“traveling” to generally encompass overnight travel, through multiple counties.
The change in the law, effective September 1, 2005, places the burden of proof on the
State rather than the citizen as to whether or not the citizen was traveling. In other words, the
State must prove beyond a reasonable doubt that the citizen was NOT traveling, rather than the
citizen having to prove that he or she WAS traveling. The new law also describes the
circumstances under which a citizen will be presumed by a jury to be traveling.
Some local law enforcement and prosecuting agencies have indicated that they will
continue to make arrests and file charges when they encounter citizens carrying handguns in
motor vehicles and will allow juries to determine whether citizens were traveling. DPS has no
authority to determine or to comment on how this law will be enforced by the various local law
enforcement and prosecuting agencies in the State of Texas.

I carry mine to and from work loaded in plan view! I'm not supposed conceal mine.....
That's for a commissioned lic....
I seem to remember a statue in the law that sort of explained traveling as transversing one complete county from your own. Meaning if you live in Tarrant county and drove through Dallas county to Rockwall county you'd be considered as traveling.
Of course I'm usually on my way to a gun show, range or smith when I've got mine in the car.

You are talking about the bona-fide traveler law in Texas. This law states that if you are moving from point A to point B and traveling over several counties to do (and w/an overnite stay) so, you are considered a bona-fide traveler and can carry. However, as you mentioned this is NOT a defense to prosecution. You can (and most likely will) be taken to jail, as most LEOs are not aware of this law. Then, although the burden of proof is on the state, you are out $$$ for bail and legal fees.
If you are going to the range, the gun must be unloaded and kept in a box and preferably locked. Ammo should be kept in a separate place (glovebox, etc.).
If you do not have a CHL, carrying a loaded weapon is illegal.
BTW, I am a CHL holder and my best friend works for University Park PD.

+1 i just went through police academy and he is right it is the officers discretion on whether to arrest or not!!!! So prob not a good idea. You would more than likely get off if your record is ok but you WILL get screwed on the court cost.

i got pulled over by a trooper just north of glenrose he said there was no problem with me carring a loaded gun including the one in the pipe, after he asked me about it he did search my truck and unload it but said it wasnt a problem

Having no CHL and driving around with a gun in the car pretty much equals a crapshoot. It all depends on the Officer that stops you. The best bet is don't get stopped and you won't have to worry about it. Usually you can get a feel for what the person is up to if you talk to them for minute but, some Officers don't take the time or care about it. They just see gun + no CHL = jail. It's cheaper to just get a CHL.
