I purchased my gixxer back in oct of last year. Ive been paying off the two small loans I took out thru HSBC and GEMB on credit cards for my bike.
I get a call this week from some lady saying HSBC has hired her to return the bike and she needs to set up a time to pick up my bike.
I have been paying my payments to the two companies. I assume HSBC has the lein. I have not had one check cashed by HSBC. They have never cleared my bank.
I have been out for medical reasons in the past and was nowhere near any of my finances or able to deal with them. I have caught up all my debits from this time with the exception of HSBC. I do not live at the address where the notices were comming back. This is the first I have heard of the impending repo. I now am told that I have to return the bike (yea right) or they will put a warrant out for me?
I didnt think it possible for someone to put a warrant on me for bad credit. And secondly if I resend my money to HSBC do they have to take it?
I have not payed off my bike yet, and I will not get a repo on my name.

First thing's first call them immeditely and tell them that you are sending them money what payments you owe them.
Second they do not send a warrant they get a Court Order too get the bike wich im willing to bet $100 says there not going to do that or atleast not right now. It also doesnt matter what your address is Repo guys will find where you live it's not Hard.
Third keep your bike in your Garage if the Repo guy come's DO NOT LET HIM HAVE IT by law he cant come in your Garage and get it without YOUR PERMISSION. He will say he has a Court Order and blah blah but make him show it too you wich he prolly wont. If the guy doesnt want too leave and of course he will Intimidate you to get you to let him take the bike Just ask him to leave or you will call the Police.
Trust me The police can't make you give the bike over unless He has a Legit Court order. But call the police on him cause he will not leave, Trust me i have brother and uncle that our Police Officer's in Ft.Worth and they hate Repo guy's.
Lastly call the HSBC and work it out with them they by all means do not want to do a repo they lose $$$ so call them tell them your situation and they will more than likely work with you on getting it cought up.
I cant stress enough to put it in your Garage if its in the driveway he can get it but if it's in your Garage he cant come in and get it w/out your permission. Do not listen too the B.S he feed's you remember he gets paid when he get's the Bike so he will say anything to get the bike, just remember he need's a COURT ORDER too take it out of you garage. And even if that i would still call the police if he had one to verify that it is a legit court order.

So you've been making payments but none of them cleared the bank? I'm always checking whatever companys I pay bills to and make sure they've cleared. It's easy enough to do especially with most company's allowing you to check your accounts online. Sounds like you screwed up to on this.

I'm pretty sure you can pull the wool over on the Repo man, just tell him, "Look, I don't even have a GSX-R! I just have this little old GIXXXER, it's an entirely different motorcycle!"
Looks like you fucked this football, have fun.

Yea, I know its not a good situation to be in. I kinda couldnt help it as I was incapaciated in the hosp. The whole heart transplant thing is kina life involved and takes president over the bike payment and other luxuries.

So either go down there and pay up (if they will let you) on it in person or just go turn it in. Do you really want an armed redneck camping your house 24x7 ??
Sounds like that would be embarassing to have the whole neighborhood in on some guy trying to repo your bike and camping your house, and harassing you every time you leave. And forget about riding it anymore right? the min you get off he'll snatch it. Its not worth all that BS.

I repo'd for a bit, not too sure on all the laws though. The ethics of repo companies and employees vary WIDELY.
First thing to do is secure the bike inside so it's not easy to see, immediately after that get on the horn with the leinholder that has the problem. A reposession is the last thing they want to happen. Well I guess worse could happen, but most lien holders would much rather work out a way for you to pay them than to have to go through a reposession. You need to stay in constant communication with them, no matter how shitty their customer service is.
There are some shady repo guys that will come in a garage to perform the repo, the law be damned. Make sure you can't tell it's in there from the outside (if you have windows on the garage door, wall, side door etc. ) If they get away with it at that point, you are screwed, you can call the cops, but it won't help any.
In Texas, the cops can't help or hinder a repossession. I'm forgetting somethinbg semi-important right here about Texas being a self-help state and this being a *blank* matter and a court order yadda yadda yadda. Rarely will repo men bother with a court order, there are easier repos out there to go get. If you really manage to piss one off, then he might bother with it. I know it can be hard, but try to maintain your cool if you deal with the repo man face to face, piss him off and he's lible to get shady on you too :(
By law, repo men can't disturb the peace while performing the repo, if they are intimidating you, call the cops, the cops will make them leave.
While working as a repo man, that's the first time I was ever treated with respect by the police. I felt like their was an understanding between myself and the officers I came in contact with. Cops get plenty of hate, the repo man is hated, but both are doing a good thing for us all. Only once did I get treated like shit. It was in a small town and I think one of the cops was related to the debtor in one way or another. He asked me to describe her, I used track marks in my description, at that point he lost it. I was thinking "OH SHIT, that woman is his sister, his cousin, his girlfriend, or all three! I'm fucked!"

Well, that would be stupid to go and try to pay it up in person on the bike. Are you kidding me. (are you the repo man?) And the mailing address where I have been getting the notices are where the redneck is posted up. I live nowhere near there or even in the same state as that. (tx) The bike is in a friends storage and I never go and ride cause Im always out of town. Not worried bout him getting the bike by being sneaky. Let him camp in Dallas or Houston or even Mineral Wells as the bike and myself are no where near any of these places. I tried contacting the repo place to talk to them and they have no msg or answer service. I have tried to call HSBC but they are only open when Im out in the field. Hopefully this week Ill have a moment during their 9-5 customer service times.

i had a friend that had the same prob with HSBC, what he did was he took all the fairings off the bike and the front wheel, then when the repo dude came he was there and told him it had been in a wreck... the repo dude called into HSBC and they told him to leave it cause they dont want a wrecked bike. they cant salvage it. so he put it back together and rides it still today. this was 2 years ago

hey man i work for finance company doing repossessions, and what most people have told is correct, they cannot enter your property (garage) without your permission, and the cops wont do anything but ask him to leave if you complain.
if you decided to make payments, that would be the best thing, i would send anything my mail, (checks, money orders), just send them a money gram or western union payments, for the most part you have way to track and confirm that the payments were made, once you bank sees that you made paymenst they will have no choice but to call off the repo guy.
the last thing you want is a repo on you credit that was screw you for 7-10 years and that would suck.
my opinion just send a few payments and they will get off you back.

nice quote... your fucking point is?
As soon as I was released from the hospital I returned to work. Im not some desk jockey, I work out in the middle of nowhere, where I do not have the time or means to contact the HSBC people. Today was the first day I was able to contact them. They are only open from 9-5 central.

Let me get this straight, you just had a heart transplant, got released from the hospital and when right back to work out in field in the middle of nowhere. Thats a amazing recovery. Almost sounds to good to be true.
Just out of curiosity, if you can't make your bike payment, how do pay back a half a million or so for a heart transplant?

I have sent the payments via handwritten mail as I am not where my bills are being sent. Secondly I have not sent a few in in the past months due to the hospitilization for complications of my heart transplant I had in 1989.

Yes as soon as I was released from the hosp I returned to work. I do not want to lose my job and I am one of 3 that are qualified to do it in the US. My parents are wealthy and I make good money... I didnt not pay them because I was un able to regulate my finances out of my hospital bed.
Having the money was not an issue. please reread and comprehend

Ok from my experiance setting accounts up for repossesion, the repo man can find you. We have OSA's (Outside Agency's) that can find people who have moved. What they do is use the internet to find anything and everything about you. Including your family to locate you. The guys will call your relatives, act like an old friend, and get a # for you. Then off that # they can use sites on the net to do a reverse # look up to find the address for that #. Or they will run your Vin# (Given by lender) to see when/where the vehicle was last registered and find you that way. At our company if a customer refuses to pay and refuses to surrendor the vehicle then we "Go Legal" on them. That means getting a court order to take the vehicle, then we send the repo man alond with the County Sheriff out to your place to take the vehicle. Right now I am working "Katrina Accounts" out of LA, MS, AL, TX, etc and doing a lot of repo's. We have people that have not paid since 07/05 and are acting like it is no big deal because of a Hurricane that hit almost a year ago.
As said do your best to contact the Co (lunch break maybe) and make some arrangements. What I tell people that say they have sent in payments but we have not received them is, "Good so you have the $$ avaliable in the account here is Money Gram's info to send the $$ or we can take a check by phone." Most however backpeddle saying "Oh well I don't have it now, I thought you cashed my checks and I have spent it elsewhere." To that I say "Well you have till Friday to get it in or I will send someone out to pick up MY vehicle." Depending on the Co. they may also Charge Off the account. Which is where they chaulk it up for a loss, c/o the account, and it effect your credit like a repo. What sucks about it is that you no longer owe us money, but now you owe an outside co. (that we sold the debt too) money and they will hound you till you pay. Plus with a c/o you don't get a title (no more registering the vehicle) till the debt is paid. Good luck man collections company's can suck ass, I know I work for one.

Just out of curiousity, why not pay cah for the bike if you make good money and your folks are rich? On top of that, why finance through HSBC? I've has two loans through them and I got royally screwed on intrest rate. I transfered the balance over to a low intrest credit card and reduced my payments. You may want to figure that route, I pay 2.9% on my busa. My HSBC loan was set at 16.9% which was bs through the dealer.
