I bought a new helmet on there early last week. paid the seller the day the auction ended. i then sent him an email asking for a tracking number. he never replied, but i did receive the helt on monday. interesting thing happened tonight when i got home. there was another package at my door. since it was a different box than the first i opened it just to see. sure enough the guy sent me another helmet. same exact one as the first! good deal huh? jk!

being the nice guy i am, i have already messaged him to inform him of what has happened. i am sure that he will reply back quickly, but what if he doesnt? afterall he didn't reply back to my simple request. should i wait to send it back or just go ahead and do it? should i wait to see if he sends a reply? after how long of not getting a reply should i consider it mine? what should i do? what would you guys do?

You are a better man if you return it. But if he dosent want to pay for the shipping then I might reconsider.

I had something like that happen with a nitrous kit. One of them got lost so they sent me another and after I got the first one another one showed up at my door. I let them know what happened and left it for them to pick up. If they wouldnt have picked it up I would have kept it but they got it.

I have no problems sending it back to the seller. I am not going to pay for shipping though. I feel that I was nice enough to admit there was an error made and leave the rest to him. I have asked a lot of people at work this morning and they pretty much say give him until the end of business tomorrow to reply. if i dont hear anything from him, then consider it mine. does that sound fair?

Sorry man, it took me a while to reply back. I'll paypal you the freight amount, then you can send it to my new address. Sorry about the misunderstanding, and thanks for being honest, i really appreciate that.

If you screwed up like that, how long would you want someone to give you to figure out the mistake?

When you do a lot of business on eBay it's easy to get over 100 emails per day and it takes time to go through everything. One day isn't enough IMO, especially if the seller, like many others, has a day job too.

Not everyone spends 24-7 sitting on their ass in front of a computer so he may not have gotten to your messages yet.

Why not give him a month, I mean, it's not like you are out anything. If he doesn't figure it out until next Monday are you just going to tell him tough shit??? I understand he made a mistake, but I've always been told to never fuck with another man's livelihood (or car for that matter) and if you don't give him atleast a week or so that's pretty shitty.

I think it's funny how everyone on this site gets so worked up when soemones car gets stolen, but so many people think you should just keep the helmet. I understand stealing something straight out isn't the same as keeping something you didn't pay for, but it's still wrong and not much different.

you make a good point. i am just going to hold it for now. im not going to give him forever though. there has been a lot of interest in it.

i even went as far as to try to track down a telephone number under his business name but came up with nothing. i am working to get it back to him!

i decide to be a little more reasonable with this guy. i still have the helmet and have tried to contact via land line. he has my info now and can call me if he wants it back. i will give him some time to get back to me. at least until wednesday. that would be a week. then all bets are off and it will be for sale.

Making a profit off of someone elses mistake is not being an honest person.

WEll, i honestly don't see the big deal. He's tried numerous times to get in contact with the person. I mean yes, the good thing would be to return it, but why eat the $20 or so in shipping? Thats not his responsibility.

Orrrrr, what you could do, is sell it for what you bought yours for, and send him the money?

05-09-2006, 05:57 PM
wait until you can reach him. For people in business it may take some time to figure out a mistake has been made. I had the same thing happen. I called the company and explained what had happened. They paid the return freight no questions asked and expressed their appreciation. You could always ship it COD. You can't go wrong by doing what is right. :)

agreed. im just gonna sit on it for a month or so. then ill try to contact him again. if i still cant get a hold of him then i will send an email stating that i sold it for what i paid for the first. then if he comes back later wanting it back, ill send him the money outta my pocket. its basically a win win situation for both of us.

if he never tries to get it back then i got a free helmet. if he comes back in 8 months sayin "hey you owe me a helmet", ill send him the money. in the mean time i "had" a free helmet. sounds fair enough to me. im not going to lose more money on the deal other than the original purchase price. call me wrong, but i wouldn't give a random person $20 just for shits and giggles.

and the other interesting development i found. the number i found for his company is actually linked to motorcycle dealership. i called asked for him and he wasnt there. i spoke to a manager there and he didnt know anything about the dealership having an eBay store.

the shipping address on the box was his home address, which i used to get a home number that no one answered after calling several times.

no one can say that i havent tried to get in contact with him. i have sent two emails and called two different numbers trying to get a hold of him. i left my contact info with the dealer to have him call me, but nothing has been done yet.

I don't think you should have to eat the shipping, I wouldn't. I do have to say "thumbs up" for trying to do the right thing. I've learned the hard way, karma is a bitch I don't want to F with :D
