Help I got ripped off!!!!

I bought a car from Whiteboy a little over a month ago.I trusted him to get me the title from his friend Stacy.Well to my surprise still no title,I have paid him a long time ago and all he tells me is Stacy is taking a long time.I'm pissed because when I bought it I told him if there was no title I didn't want it!He told me the money order he sent Stacy got lost and all kinds of BS.I'm screwed and he told me its not his problem that I need to deal with Stacy.I told him either give me the title or my money back!What should I do?

Bummer, buying a car and not walking away with the title is bad. Not checking the car out before you buy it is bad.

It sucks to get screwed but it sucks even more when you do it to yourself. If I were you I'd be making sure the car was actually theirs to sell, as in no liens etc...

Never buy a car from an individual if they can't produce the title! That's usually a sign of bad things to come. If they have it and they want your cash they'll get it. Once they have the cash they aren't too motivated to do anything for you.

I am in a similar situation, but I am on the bad end of it. I bought a car from a coworker over a year ago, and he provided me with the title, and it was signed by the person he got it from. He never registered it in his name, and I never registered it in my name. I sold it to a friend of a board member, and now the state wants a Bill of Sale signed by the original owner, and I can't get one. I have no idea how to find the person he got it from, and apparently he doesn't either. So now I am screwed, because I can't get a bill of sale and may have to buy the car back.

That's not necessary. You can prove he sold you the car by the posts on this site. Chris backs up all the info including PMs, so even if whiteboy deleted the original posts, Chris can recover the files.

Damn Albert you should have never bought the car without the title or only given half of the money til you got it, that is the most important thing to do when buying a car, other than checking out before you buy it. I kinda of understrand that you guy's know each other maybe thats where the trusting came in, but you can go to a title company and get a title. It will cost you a few hundred dollars but you will get it, remember possesion is 9/10's of the law. I once bought a car without a title and I had to do that exact thing...'H'

I know some shit face sold me a shell and I payed half price, then was going to pay the other half when he got the title for me. He kept dicking around and finally the car was stolen from outside a friends shop. So a year later he calls saying he has the title and wants the rest of his cash. I told him tough cause the car was stolen and he threatened to sue me blah blah... so anyway, a friend of my dad's (retired from DPD) told the guy if he takes it to court it'll be his ass for selling it without title in hand... last I heard from that schmuck.

I suggest you start gathering all the evidence you can. Get the above from Chris, document all your conversations with whiteboy, phone, email, etc. Get proof of your bank draft/money order to pay for the car, etc.

You can prove this easily with the above information: Whiteboy was selling said car, you withdrew money, bought a money order, and paid for said car. Accepting payment, whiteboy gave you the keys, a promise of quick delivery of the title, and allowed you to take possesion of the vehicle. After the date of sale, you still have possesion of the car and messages from whiteboy concerning the money order, title, etc. This is nearly as good as a bill of sale. It is easy to prove that you purchased the car for said price on said date from whiteboy.

Money orders have to be cashed, obtain a copy of the cashed money order and see if/who/where it was cashed. If the money order was given to whiteboy....then whiteboy assumed legal responsibility to deliver it to the vehicle's owner. Whiteboy is acting as an intermediate arbitrator representing the seller. Thus if it was lost, as Whiteboy admitted it was, it is very much so Whiteboy's problem. It would be the same if you bought a new car and the dealer called you after the sale date and said they sent your money to auto manufacturer as payment for the vehicle and it got lost. That is the dealers problem, not yours. You kept up your end of the bargain.

Take him to court if you have to, but hopefully you can resolve this matter without any legal intrusion. IT IS IN WHITEBOY"S BEST INTEREST TO RESOLVE THIS WITHOUT INVOLVING THE AUTHORITIES. It is very likely that after the civil case, a judge would refer this to the criminal courts.


Not to be rude Albert, but no bill of sale was a mistake....you should always get one. Good luck with this matter.

I sold a 7-up Stang to a guy 2 years ago that never wanted nor tried to get the title from me (At the time of sale it was getting transfered in my name and I did not have it either), and was racking up tollway and parking fines for a bit:mad: We were getting them in the mail but were dismissed due to a bill of sale:D The guy still has not tried to get nor wanted the title from us.. Can I hitch the car and bolt since I have the title?? We have made several attempts to get him to drive down from Frisco and sign the title transfer slip, but never get a response:confused: I have even banged on the door at his residence with the car 50 ft from me, and still did not get a response.. I can kinda understand what Whiteboy and Albert are going through..

You won't see this because it isn't true. The only thing the seller needs is the legal right to sell the car which could be that they either own the car or are representing the owner in the sale. The law here is the law of common sense and that say don't give anyone your cash unless you get the title. a big misconception is that a bill of sale is in some way useful. It means nothing unless the seller has the legal right to sell the car. People that take a bill of sale are risking losing their cash.

You don't have to have any business with the guy. As has been said before, do your homework before you sell or buy a car and this crap won't happen.

I bought a car and this is how the title changed hands, buyer one bought the car from the orig owner, title never transferd, buyer 2 bought the car from buyer 1 title never transferd, then i bought the car, and i have the title, I was told to get a bonded title and that will take car of everything, is this correct? Any place reccomended to have this done in the plano/richardson area?

I just recently had to get a bonded title, it is no fun but here is how you do it:

In my case I had bought the car from someone on this website. The last legal owner of the car was 4 "owners ago" Mr. Schmidt had sold it to some lady and that lady had sold it to the guy I bought it from. But the title was in Mr Schmidt's name still. Now since I could not track down all 3 of the previous owners, I had to get a bonded title.

First, go to your local tax office and tell them that you want to get a bonded title. They will give you a packet to fill out and the address of a place to take it located in Carrollton, I believe.

Fill it out and take it to the place they tell you to. From here they will do a shit load of paper work, give it all to you and tell you to go apply for a Surety Bond.

Pick an agency through which you want to get a Surety Bond, and bring a Bill of Sale from the person you bought the car from. The Bill of Sale should say "So-and-so bought a (year)(make)(model) from So-and-so and paid in full at ($amount).

Here you will have to plunk down $150 for the Bond, and be DAMN SURE the car isn't stolen. If the car ends of being stolen, you have to pay the value of the car to the bond agency :eek:

Anyway, after you get the Surety Bond...head back to the local tax office and have the titles swapped. Be careful though, you will have to pay sales tax, etc.

Now, the easier way to do all of this is if you can track down the list of people back to the previous owner (the one who's name is on the title). If you can do that, then you should be able to do a title transfer directly. Much easier that way, and much cheaper than the surety bond way.
